Section 59

Settlement of disputes

(1)

Any dispute, of whatever nature, between a seaman and the person employing the seaman, the master or the owner of a ship may be submitted by any party to the Director for decision, or, in the case of a dispute relating to the amount payable to a seaman under a crew agreement and the amount exceeds $5,000, by all the parties involved except that if the Director is of opinion that the dispute is one which ought to be decided by a court of law, the Director may refuse to decide it.

The decision of the Director on a dispute submitted to the Director under this section is final.

(3)

An award made by the Director upon the submission is conclusive as to the rights of the parties, and the submission or award does not require a stamp; and a document purporting to be the submission or award is admissible as evidence thereof.
