Section 13

Removal of projections or obstructions

(1)

The Authority may give notice to the owner of any land or building in the street reserve requiring that owner to remove any object or structure described in the notice which is erected on or attached to, or projects from, the land or building if in the opinion of the Authority the removal of the object or structure is required for the purposes of the construction of any street.

(2)

A notice under subsection (1) may be given to the owner of any land or building and is deemed to have been received by the owner if it is affixed to some conspicuous part of the land or building to or from which the object or structure is erected or attached or projects from.

(3)

A notice under subsection (1) must —

(a)

describe the object or structure to be removed;

(b)

stipulate the period within which the work of removal must be carried out;

(c)

be given to the owner of the land or building not later than 28 days before the commencement of that period; and

(d)

state that any person entitled to compensation in connection with the removal of the object or structure may serve a written claim upon the Authority in accordance with the provisions of the Land Transport Authority of Singapore Act 1995.

(4)

If the owner of the land or building does not comply with a notice given to the owner under subsection (1), any person authorised in that behalf by the Authority may enter the land or building, together with such other persons as the person authorised thinks necessary, and remove the object or structure described in the notice or cause it to be removed by those other persons.
