Section 12

Initiation of challenge

(1)

A supplier who wishes to bring a challenge before the Tribunal (called in this Act the applicant) must, within 15 days from the date the facts constituting the basis of the challenge first took place —

(a)

lodge with the Registrar a notice of challenge (called in this Act the Notice of Challenge);

(b)

pay the Registrar the fee prescribed (if any) for bringing a challenge before the Tribunal; and

(c)

serve a copy of the Notice of Challenge on the contracting authority undertaking or who has undertaken the procurement that is the subject of the challenge.

(2)

The Notice of Challenge must be in such form and must contain such information, and be accompanied by such documents, as may be prescribed.
