Section 37
False statements
(1)
A person must not, in or in relation to an application or a notice under this Act, knowingly or recklessly —
make a statement that is false or misleading in a material particular; or
give to the Director‑General or an authorised officer a document containing information that is false or misleading in a material particular without —
indicating to the Director‑General or authorised officer that the document is false or misleading and in which respect it is so; and
providing correct information to the Director‑General or authorised officer if the person has, or can reasonably obtain, the correct information.
(2)
A person must not, otherwise than in or in relation to an application or a notice under this Act, knowingly or recklessly —
make to the Director‑General or an authorised officer doing duty in relation to this Act a statement that is false or misleading in a material particular; or
give to the Director‑General or an authorised officer doing duty in relation to this Act a document containing information that is false or misleading in a material particular without —
indicating to the Director‑General or authorised officer that the document is false or misleading and in which respect it is so; and
providing correct information to the Director‑General or authorised officer if the person is in possession of, or can reasonably obtain, the correct information.
(3)
Any person who contravenes this section shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both.
