Section 23

Penalty under this Part

Any person who fails to comply with any notice or order made under this Part, or contravenes any of the provisions of this Part, shall be guilty of an offence and shall be liable on conviction —

(a)

in the case of an offence under section 17, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 3 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 6 months or to both; and

(b)

in any other case, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 3 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both.
