Section 30

Director-General to have regard to certain provisions

In acting under section 28 or 29, the Director‑General must have regard —

(a)

to the relevant provisions of any code of practice published or mentioned in the regulations;

(b)

before specifying any particular methods or plant or machinery, to the desirability in the interests of any recipient of the notice in question of specifying other methods or plant or machinery which would be substantially as effective in minimising noise and would be more acceptable to that recipient; or

(c)

to the need to protect any person in the locality in which the premises or work place in question are situated from the effects of noise.
