Application for leave of Court, etc.
(1)
An application for the leave of the Court or the appellate court to appeal or an application mentioned in section 21A(1), 36(6) or 49(3)(b) or (7) must be made in the manner that may be prescribed in the Rules of Court.
(2)
The Court is to determine an application for leave to appeal without a hearing unless it appears to the Court or the appellate court that a hearing is required.
(3)
For the purposes of this section —
an application for leave of the Court may be heard and determined by a Judge sitting in chambers in the Court; and
the appellate court has the like powers and jurisdiction on the hearing of such applications as the Court or any Judge sitting in chambers in the Court has on the hearing of such applications.
