Composition and procedure of Appeal Panel
(1)
An Appeal Panel established by the Minister is to consist of at least 3 persons, one of whom must be appointed by the Minister to be the chairperson of the Appeal Panel.
(2)
The Minister may, in establishing an Appeal Panel, provide for —
the terms and conditions of the membership of the Appeal Panel as the Minister considers appropriate;
the procedure to be adopted by the Appeal Panel in considering any matter referred to it; and
any other matters which the Minister considers incidental or expedient for the proper and efficient conduct of an appeal by the Appeal Panel.
(3)
The remuneration and allowances (if any) of a member of an Appeal Panel are to be determined by the Minister and —
subject to paragraph (b), form part of the expenses of the Authority; and
where the Appeal Panel is established for the purposes of section 20A, must be borne equally by E and the transmission licensee, or in any other proportion between E and the transmission licensee that the Appeal Panel may specify.
(4)
An Appeal Panel must be independent in the performance of its functions.
