Offences under this Subdivision
(1)
A person who, without reasonable excuse, refuses or fails to comply with a requirement under section 89 or 90(3) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both.
(2)
A person who, without reasonable excuse —
refuses or fails to take an oath or make an affirmation when required to do so by an investigator examining him or her under this Subdivision;
refuses or fails to comply with a requirement of an investigator under section 92(2)(a); or
refuses or fails to comply with section 93(2) or 94,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 12 months or to both.
(3)
A person who, in purported compliance with the provisions of this Subdivision, or in the course of examination of the person, provides information or makes a statement that is false or misleading in a material particular shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both.
(4)
It is a defence to a prosecution for an offence under subsection (3) if the defendant proves that he or she believed on reasonable grounds that the information or statement was true and was not misleading.
(5)
A person who, without reasonable excuse, obstructs or hinders the Authority or another person in the exercise of any power under this Subdivision shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both.[71I
