Section 43

False or misleading information, statement or document

(1)

Any person who —

(a)

provides information to the Agency or any officer or employee in connection with any function or duty of the Agency under this Act which is false or misleading in a material particular; (b)obtains payment from the Agency of any incentive, grant or loan under this Act or any other written law by means of any false or misleading statement or any document that is false or misleading in any particular; or

(c)

intentionally alters, suppresses or destroys any document or information which the person is required by the Agency under section 41 to furnish,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both.

(2)

To avoid doubt, it is not a defence in any proceeding for an offence under subsection (1)(a) that the accused did not obtain any incentive, grant or loan from the Agency.
