Section 25
Lien on goods supplied
(1)
Subject to the provisions of this Act, the claimant has a lien on goods supplied by the claimant to the respondent under the contract concerned that are unfixed and which have not been paid for.
(2)
The lien under subsection (1) subsists if, and only if —
the claimant has served on the respondent the notice mentioned in section 23(1)(a);
a copy of the notice has been served by the claimant on the principal (if known) and the owner concerned;
7 days have elapsed since the notice was served on the respondent, the principal (if known) and the owner, or since the last of them was served the notice; and
the claimant has not been paid the adjudicated amount.
(3)
The lien under subsection (1) does not give the claimant any priority over the liens on the goods existing before the date on which the firstmentioned lien arises.
(4)
The claimant has no rights to exercise the lien mentioned in subsection (1) —
if the goods concerned are owned by a person other than the claimant or the respondent; or
during the period mentioned in section 24(3).
