Power to require information in respect of contraventions
(1)
Where it appears to the Commissioner or any authorised officer that there may have been a contravention of any provision of this Act, he or she may serve an information notice to require any person who appears to the Commissioner or authorised officer to be acquainted with the circumstances of the case to provide him or her, within such time as may be specified in the notice, with information relating to that case in the possession or within the knowledge of that person.
(2)
An information notice under subsection (1) must be complied with by giving the required information in writing to the Commissioner or authorised officer, as the case may be.
(3)
Any person who fails to comply with any notice under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
(4)
It is a defence for a person charged with an offence under subsection (3) to prove that the person did not know and could not with reasonable diligence have ascertained, the information required in the information notice.
(5)
If any person —
makes any statement purporting to comply with a requirement of an information notice which the person knows to be false or misleading in a material particular; or
recklessly makes such a statement which is false or misleading in a material particular,the person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
