Codes, standards of performance or specifications issued or approved by Authority

(1)

The Authority may —

(a)

issue one or more codes, standards of performance or specifications applicable to casino operations;

(b)

approve as a code, standard of performance or specification applicable to casino operators any document prepared by a person other than the Authority if the Authority considers the document as suitable for this purpose; or

(c)

amend, add to or revoke any code, standard of performance or specification issued under paragraph (a) or approved under paragraph (b).

(2)

If any provision in any code, standard of performance or specification is inconsistent with any provision of this Act, such provision, to the extent of the inconsistency —

(a)

shall have effect subject to the provisions of this Act; and

(b)

having regard to the provisions of this Act, shall not have effect.

Where any code, standard of performance or specification is issued, approved, amended or revoked by the Authority under subsection (1), the Authority must —

(a)

notify each casino operator and any other person licensed or approved by the Authority who may be affected by the issuance, approval, amendment or revocation;

(b)

specify in the notice referred to in paragraph (a) the date that the issuance, approval, amendment or revocation is to take effect; and

(c)

ensure that, so long as the code, standard of performance or specification remains in force, copies of that code, standard of performance or specification are made available to the casino operators and any other person required to comply with the code, standard of performance or specification.

(4)

Any code, standard of performance or specification issued or approved under this section —

(a)

may be of general or specific application; and

(b)

may specify that different provisions thereof apply to different circumstances or provide for different cases or classes of cases.

The Authority may, either generally or for such time as the Authority may specify, waive the application of any code, standard of performance or specification, or part thereof, issued or approved under this section to any casino operator or other person.
