Section 18

Confidentiality

(1)

Except as provided in subsection (2), every person exercising any function under this Act must keep confidential any information that is obtained pursuant to this Act concerning the affairs of another person, including but not limited to information with regard to any manufacturing process or trade secret.

(2)

The information in subsection (1) may be disclosed —

(a)

with the consent of the person to whose affairs it relates;

(b)

in connection with anything done for the purposes of this Act, the Safeguards Agreement or the Nuclear Material Convention;

(c)

in connection with the investigation of a criminal offence or for the purposes of criminal proceedings;

(d)

in compliance with the requirement of any court, tribunal, authority or person having lawful authority to require the production of documents or the answering of questions;

(e)

for the purpose of dealing with an emergency involving public safety or ensuring the security of Singapore; or

(f)

if the information is already in the public domain.

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $6,000 or to imprisonment for a term not exceeding 12 months or to both.[17
