Exemption from requiring airport licence
(1)
The Authority may, with the approval of the Minister, by order in the Gazette, exempt any person (called in this Act an exempt airport operator) from complying with section 36(1) for any specified period generally or to such an extent as may be specified in the order, and unconditionally or subject to such conditions as may be specified therein.
(2)
Without limiting subsection (1), the conditions of an exemption may require any exempt airport operator operating an airport pursuant to the exemption —
to comply with any direction given by the Authority as to any matters that are specified in the exemption order under subsection (1) or are of a description so specified;
to do or not to do any things that are specified in the exemption order under subsection (1) or are of a description so specified, except insofar as the Authority consents to the exempt airport operator doing or not doing them; and
to refer for determination by the Authority any questions arising under the exemption that are specified in the exemption order under subsection (1) or are of a description so specified.
(3)
An exemption order under subsection (1) continues in force, unless it is revoked, for such period as may be specified in the order.
(4)
Any exempt airport operator who fails to comply with any direction mentioned in subsection (2)(a) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 2 years or to both.
(5)
Without affecting subsection (4), if any condition of an exemption granted to an exempt airport operator is not complied with by the exempt airport operator, the Authority may give to that exempt airport operator a notice declaring that the exemption is revoked, insofar as it relates to that person, to such extent and from such date as may be specified in the notice.
