Section 54

Record-keeping and giving information on quality of service

(1)

An airport licensee, and every person who provides airport services and facilities under an agreement with an airport licensee, must —

(a)

keep and retain records for such period as may be prescribed, where the records are relevant to a matter that is relevant to monitoring or evaluating, under this Part, the quality of an aspect of airport services and facilities as prescribed in the regulations; and

(b)

give to the Authority within the period and in the manner prescribed in the regulations, specified information that is relevant to a matter that is relevant to monitoring or evaluating, under this Part, the quality of an aspect of airport services and facilities as prescribed in the regulations.

(2)

An airport licensee, or a person who provides airport services and facilities under an agreement with an airport licensee, must not, in purported compliance with a requirement under subsection (1), make a record of any matter or thing in such a way that it does not correctly record the matter or thing.

(3)

An airport licensee, or a person who provides airport services and facilities under an agreement with an airport licensee —

(a)

who is subject to any requirement under subsection (1) or (2); and

(b)

who contravenes any such requirement,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both.
