Section 88

Fees, charges and late payment penalties

(1)

The Authority may, with the approval of the Minister, by order in the Gazette —

(a)

impose fees and charges for air navigation services and other facilities and services the Authority provides at or in connection with any airport;

(b)

impose penalties for the late payment of any such fee or charge;

(c)

impose interest for late payment of any such fee, charge or penalty; and

(d)

provide for any payment thereof by instalment.

(2)

Any such fee or charge or penalty or interest for late payment may be set either by fixing the amount or by setting a method of calculation.

(3)

Different rates of fees and charges may be so prescribed or fixed in respect of different classes of persons, airports, aircraft or services, or on the basis of different times of use or on any other differential basis.

(4)

Any such unpaid fee or charge or instalment thereof, or unpaid late payment penalty or interest, may be recovered by the Authority as a debt in a court of competent jurisdiction.
