Section 61

Disclosure of conflict of interests by members of Appeals Board

(1)

A member of the Appeals Board must declare to the Minister, or any person authorised by the Minister, the nature and extent of any actual or potential conflict of interests with his or her duties or interests as a member of the Appeals Board arising from —

(a)

the member’s holding of any office;

(b)

the member’s interest in any contract;

(c)

the member’s possession or ownership of any property;

(d)

any direct or indirect relationship with any estate agent or salesperson; or

(e)

the member’s connection or association with any trade or consumer body.

(2)

Where the Minister, or any person authorised by the Minister, is satisfied that a member of the Appeals Board is or may be unable to carry out his or her duties properly and effectively because of any actual or potential conflict of interests, the Minister may replace that member or direct that member to abstain from taking part in any proceedings that is or may be affected by the conflict of interests.
