Appointment of Complaints Panel
(1)
For the purpose of enabling Complaints Committees and Disciplinary Tribunals to be constituted in accordance with this Part, the Council must appoint a panel (called in this Act the Complaints Panel) consisting of —
a Chairperson and one or more Deputy Chairpersons, from among the members of the Council;
at least 10 and not more than 100 members, who are registered allied health professionals each of whom has at least 10 years’ experience in the practice of a prescribed allied health profession and is not a member of the Council; and
at least 6 and not more than 50 members, who are laypersons nominated by the Minister.
(2)
The term of office of a member of the Complaints Panel mentioned in subsection (1)(a) expires at the end of his or her term of office as member of the Council.
(3)
The term of office of a member of the Complaints Panel mentioned in subsection (1)(b) or (c) is to be determined by the Council and must not exceed 2 years; and any such member is eligible for re‑appointment.
(4)
The Council may at any time remove from office any member of the Complaints Panel mentioned in subsection (1)(a), (b) or (c) or fill any vacancy in its membership.
(5)
Any member of the Complaints Panel who is employed in the Ministry of Health is not disqualified from being a member of any Complaints Committee, Disciplinary Tribunal, Health Committee or Interim Orders Committee by reason only that he or she is so employed.
