Section 21

Deceased registrants

(1)

Where a registered individual proprietor or a partner of a registered firm who is an individual dies, the Registrar may permit the personal representative of the deceased, or a person who in the Registrar’s opinion would be entitled to apply to court for an order for the administration by the court of the deceased’s estate —

(a)

to lodge any notice referred to in section 20(1) on behalf of the deceased person;

(b)

to lodge any notice to be lodged under section 20(3) on behalf of the deceased partner, together with the other persons registered as partners; or

(c)

to lodge the notice referred to in section 22(1).

(2)

For the purposes of subsection (1), a person who claims to be the personal representative of a deceased or to be entitled to apply to court for the order for the administration by the court of the deceased’s estate must provide such evidence as may be acceptable to the Registrar.
