Section 4

Administration of Act

(1)

The Director is responsible for the administration and enforcement of this Act, subject to the general and special directions of the Minister.

(2)

The Director may in writing appoint any public officer or any officer of any statutory body to be an authorised officer for the purposes of this Act.

(3)

Every authorised officer, when exercising his or her powers and carrying out his or her duties under this Act, must comply with such general or special directions as may, from time to time, be given to the authorised officer by the Director.

(4)

Every authorised officer when exercising any of his or her powers under this Act must, if not in uniform, declare his or her office and must, on demand, produce to any person affected by the exercise of that power such identification card as the Director may direct to be carried by the authorised officer when exercising such power.

(5)

The Director may, in writing, delegate all or any of the powers conferred on the Director by this Act to any authorised officer subject to such conditions or restrictions as the Director thinks fit, except the power of delegation conferred by this subsection.

(6)

The Director may, in writing, authorise any other person to assist the Director or an authorised officer in the administration and enforcement of this Act.

(7)

Every authorised officer and every person authorised under subsection (6) is deemed to be a public servant for the purposes of the Penal Code 1871.
