Section 9

Delegation of functions and powers

(1)

The Council may in respect of a specified matter or class of matters, by writing, delegate any of its functions, duties or powers under this Act to a member of the Council or a committee appointed under section 8(4), except the power of delegation conferred by this subsection.

(2)

The Board may in respect of a specified matter or class of matters, by writing, delegate any of its functions, duties or powers under this Act to a member, an officer or a committee of the Board, except the power of delegation conferred by this subsection.

(3)

The chief executive officer of the Board may in respect of a specified matter or class of matters, by writing, delegate any of the chief executive officer’s functions, duties or powers under this Act to a member or an officer of the Board, except the power of delegation conferred by this subsection.

(4)

A recovery body may in respect of a specified matter or class of matters, by writing, delegate any of its powers under this Act to any officer of the recovery body, except the power of delegation conferred by this subsection.

(5)

Without affecting the power of delegation under section 36 of the Interpretation Act 1965, any Minister who has the power to issue an approval or a direction under Part 5 may in respect of any specified matter or class of matters, by writing, delegate that power to any public officer.

(6)

Every member, officer, committee or public officer purporting to act pursuant to a delegation under this section is, in the absence of proof to the contrary, presumed to be acting in accordance with the terms of the delegation.

(7)

A delegation under this section is revocable at will, and no such delegation prevents the exercise of any power, function or duty by the Minister, the Council, the Board, the chief executive officer of the Board or the recovery body (as the case may be) which makes the delegation.
