Section 74

Duty to give information of certain matters

(1)

Every person who is aware of any information relating to —

(a)

the commission of;

(b)

an arrangement facilitating the commission of; or

(c)

the intention of any other person to commit or facilitate,any offence punishable under this Act, must, in the absence of reasonable excuse (the burden of proving which lies upon the person so aware), immediately give the information to any law enforcement officer of the commission, arrangement or intention.

(2)

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction —

(a)

in the case of a natural person, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 12 months or to both; and

(b)

in any other case, to a fine not exceeding $10,000.

(3)

For the purposes of subsection (1), it is a reasonable excuse for a person not to comply with that subsection if the person has already given the information mentioned in that subsection to a law enforcement officer pursuant to any other written law.
