Section 30

Power to order production of information, document or thing

(1)

The Registrar may, in writing, order a person —

(a)

to produce any information, document or thing in the person’s possession or control that the Registrar considers relevant for deciding whether this Act has been contravened; or

(b)

to give the Registrar access to that information, document or thing.

(2)

Subsection (1) does not apply to customer information (as defined in section 40A of the Banking Act 1970) kept by a financial institution.

(3)

A person ordered to produce any information, document or thing may cause the information, document or thing to be produced instead of producing it in person.

(4)

It shall be an offence for a person to —

(a)

fail to comply with the Registrar’s order under subsection (1) without reasonable excuse; or

(b)

knowingly obstruct or prevent, or attempt to obstruct or prevent, a person from complying with the Registrar’s order under subsection (1).
