Minister to give opportunity to make representations before revoking waiver certificate, etc.
(1)
The following provisions are to apply before the Minister makes a decision under section 44 in relation to a person granted a waiver certificate under section 43(1)(a).
(2)
The Minister must give the person written notice of —
the Minister’s intention to make the decision; and
the date on which the Minister intends to make the decision.
(3)
The date in subsection (2)(b) must not be earlier than 21 days after the date of the written notice in subsection (2).
(4)
The person may make representations to the Minister at any time before the date in subsection (2)(b).
(5)
The Minister must consider any representation made by the person before the date in subsection (2)(b).
(6)
The Minister must, on or after the date in subsection (2)(b), give the person written notice of the Minister’s final decision.
(7)
The Minister’s final decision takes effect 14 days (or any longer period that the Minister may specify) after the date of the written notice in subsection (6).
