Power to disclose confidential information
(1)
The Authority may disclose any information obtained by the Authority under this Act for the purposes of enabling the Authority to give effect to any provision of this Part.
(2)
When considering whether to disclose any information under subsection (1), the Authority must have regard to —
the need for excluding, so far as is practicable, information the disclosure of which would in the Authority’s opinion be contrary to the public interest;
the need for excluding, so far as is practicable —
commercial information the disclosure of which would, or might, in the Authority’s opinion, significantly harm the legitimate business interests of the undertaking to which it relates; or
information relating to the private affairs of an individual the disclosure of which would, or might, in the Authority’s opinion, significantly harm the individual’s interest; and
the extent to which the disclosure is necessary for the purposes for which the Authority is proposing to make the disclosure.
