Section 35

Record-keeping and giving information on quality of service

(1)

A licensee must —

(a)

keep and retain, for such period as may be prescribed, such records that are relevant for monitoring or evaluating under this Part the quality of an aspect of early childhood development services as may be prescribed; and

(b)

give to the Chief Licensing Officer, within such period and in such manner as may be prescribed, such information that is relevant for monitoring or evaluating under this Part the quality of an aspect of early childhood development services as may be prescribed.

(2)

A licensee must not in purported compliance with a requirement under subsection (1) make a record of any matter or thing in a way that does not correctly record the matter or thing.

(3)

Any licensee who —

(a)

contravenes subsection (1)(a) or (2); or

(b)

without reasonable excuse, contravenes subsection (1)(b),shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.
