Section 4

Possessing radioactive material or Convention device

A person shall be guilty of an offence, and shall be liable on conviction to imprisonment for a term which may extend to life imprisonment, if —

(a)

the person, intentionally and without lawful authority, possesses any radioactive material or Convention device; and

(b)

the person intends that the radioactive material or Convention device be used to cause —

(i)

the death of, or serious bodily injury to, any individual; or

(ii)

substantial damage to property or to the environment.
