Settlement of list of contributories and application of assets
(1)
As soon as possible after making a winding up order, the Court must settle a list of contributories and cause the assets of the company to be collected and applied in discharge of the liabilities of the company.
(2)
After making a winding up order, the Court may rectify the register of members in all cases where rectification is required under this Part.
(3)
Despite subsection (1), where it appears to the Court that it is not necessary to make calls on or adjust the rights of contributories, the Court may dispense with the settlement of a list of contributories.
(4)
In settling the list of contributories, the Court must distinguish between persons who are contributories in their own right and persons who are contributories by reason of being representatives of others, or by reason of being liable for the debts of others.
(5)
The list of contributories, when settled, is prima facie evidence of the liabilities of the persons named in the list as contributories.
