Section 301

Certificate of completion of debt repayment scheme

(1)

The Official Assignee must issue a certificate of completion of a debt repayment scheme in respect of a debtor if the debtor repays, in accordance with this Part and the debt repayment plan under the scheme, the debtor’s debts which have been proved under the scheme and included in the plan.

(2)

Subject to this Act and any other written law, the certificate of completion of the debt repayment scheme, upon being issued, releases the debtor from all the debtor’s debts provable under the scheme except a debt which —

(a)

the debtor had failed to disclose to the Official Assignee; and

(b)

in respect of which a proof of debt was not filed under the scheme.

(3)

Subsections (2) to (8) of section 397 apply to or in respect of the debtor as if a reference to discharge in those provisions is a reference to the certificate of completion of the debt repayment scheme and a reference to a bankrupt in those provisions is a reference to the debtor.
