Section 302

Revocation of certificate of completion of debt repayment scheme

(1)

The Official Assignee may at any time, by notice in writing to a debtor, revoke a certificate of completion of a debt repayment scheme issued under section 301(1) in respect of the debtor if the Official Assignee is satisfied that the debtor —

(a)

did not to the best of the debtor’s knowledge or belief disclose to the Official Assignee all the debtor’s property or the disposal of the debtor’s property (or any part of the debtor’s property); or

(b)

had obtained the approval or modification of the debt repayment plan under the scheme by means of fraud, false representation or the concealment of any material fact.

(2)

Subsection (1)(a), in relation to the disposal of property, does not apply to the payment of ordinary expenses of the debtor and the debtor’s dependants.

(3)

Upon the revocation of the certificate of completion of the debt repayment scheme, the debtor’s release from the debtor’s debts under section 301(2) ceases.
