Section 12

What is an authorial work with an identified author

(1)

An authorial work has an identified author if —

(a)

the identity of the author is generally known or can reasonably be ascertained; or

(b)

in the case of a work of joint authorship — the identity of at least one of the authors is generally known or can reasonably be ascertained.

(2)

For the purposes of subsection (1) —

(a)

the identity of the author of an authorial work is deemed to be generally known if —

(i)

the work is published; and

(ii)

the true name of the author, or a name by which the author is generally known, is specified in the published work as the author; and

(b)

the identity of an author is not generally known just because the pseudonym of the author is generally known.
