Clause 115

Order to enter

(1)

If it appears to a Magistrate’s Court, on the application of any owner of a dwelling-house, that default is being made in the execution of any works required to be executed on any dwelling-house in respect of which a closing order has been made or in the demolition of any building or dwelling-house and that the interests of the applicant will be prejudiced by such default and that it is just to make the order, the Court may make an order empowering the applicant forthwith to enter on the dwelling-house and within the time fixed by the order to execute the said works or to demolish the building and, where it seems to the Court just so to do, the Court may make a like order in favour of any other owner.

A Magistrate’s Court may in any case by order enlarge the time allowed under any order for the execution of any works or the demolition of a building.

(3)

Before an order is made under this section notice of the application shall be given to the Director.
