Clause 61
Erection of compartments, galleries, lofts, etc., in buildings
(1)
No person shall erect or cause or permit to be erected in any building any partition, compartment, gallery, loft, roof, ceiling or other structure without having previously obtained the consent in writing of the Chief Building Surveyor.
(2)
In every such case the owner of the premises shall be deemed to have permitted such erection until the contrary is proved.
(3)
Without prejudice to the provisions of subsection (4) of this section any person who acts in contravention of this section shall be liable on conviction to a fine not exceeding one hundred dollars and to a further fine of twenty dollars for each day after conviction during which the erection is allowed to remain.
(4)
The Chief Building Surveyor may cause to be removed any partition, gallery, loft or other structure which has been erected after the 1st day of January, 1908, without the consent in writing of the appropriate authority.
