Clause 48

Port dues payable in respect of vessels

(1)

The master or owner of every vessel, other than a vessel exempted under the provisions of subsection (2) of this section, which —

(a)

enters the port for the purpose of loading or discharging cargo or embarking or disembarking passengers; or

(b)

occupies an anchorage or berth within the port for a period exceeding thirty days,shall pay to the Authority port dues according to the scale set out in Part IA of the Third Schedule to this Ordinance.

(2)

There shall be exempted from port dues under this section —

(a)

any harbour craft required to pay port dues under the provisions of section 49 of this Ordinance;

(b)

any vessel discharging cargo or disembarking passengers solely for the purpose of effecting repairs or of determining whether such repairs are necessary, whether or not such cargo is reloaded or such passengers are re-embarked; and

(c)

any vessel or harbour craft belonging to Her Majesty, the Government or to a Commonwealth or foreign government, other than any such vessel loading or discharging cargo or embarking or disembarking passengers carried for freight or fares.
