Clause 21

Penalties

(1)

Any employer or contractor who contravenes any of the provisions of this Ordinance or commits an offence under section 20 of this Ordinance shall be liable on conviction to a fine not exceeding two thousand dollars or to imprisonment for a term not exceeding one year for a first offence, and to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding three years for a second or subsequent offence.

(2)

The Court before which such conviction is obtained may, in addition to such fine, order the employer to pay any amount payable under this Ordinance, certified by the Director as being due from such employer at the date of such conviction. Such amount shall be paid into the Fund and may be recovered according to the law for the time being in force for the recovery of fines.
