Penalty for acts of vandalism
Notwithstanding the provisions of paragraph (a) of subsection (1) of section 11 of the Minor Offences Ordinance (Cap. 117), any person who commits any act of vandalism or attempts to do any such act or causes any such act to be done shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding one thousand dollars or to imprisonment for a term not exceeding six months, and shall also, subject to the provisions of section 274 of the Criminal Procedure Code (Cap. 132), be punished with caning:Provided that the punishment of caning shall not be imposed on a first conviction under this Act in the case of any act falling within the provisions of —
paragraph (a)(i) of the definition of “act of vandalism” in section 1 of this Act, if the writing, drawing, mark or inscription is done with pencil, crayon, chalk or other delible substance or thing and not with paint, tar or other indelible substance or thing; or
paragraph (a)(ii) or (a)(iii) of the said definition.
