Royalty or compensation payable

Where a licence has been granted under section 3 or 5 of this Act and the patentee and the licensee are unable to agree within a reasonable time on the amount of royalty or compensation to be reserved to the patentee under the licence, the Registrar shall determine the royalty or compensation payable, but in no case shall the Registrar fix a royalty or compensation payable to the patentee under the licence exceeding ten per cent of the net ex-factory sale price in bulk of the patented article, to be determined in such manner as may be prescribed.
