Clause 104

Power to close cemeteries, etc.

(1)

If at any time it appears to the Commissioner that —

(a)

any cemetery or place of burial, crematorium or any place used for the burning of corpses is in such a state as to be dangerous to health; or

(b)

such cemetery, crematorium or place or any part thereof —

(i)

is noxious or offensive or unfit for use as a cemetery or crematorium;

(ii)

cannot be further used for the burial or burning of the dead without danger to public health;

(iii)

is being used in contravention of any condition of the licence; or

(iv)

is no longer required,the Commissioner may order the same or any part thereof to be closed and may revoke or amend the licence thereof and thereafter it shall not be lawful to use the same or such part thereof as the case may be as a place for the burial or burning of corpses.

(2)

No such closing, revocation or amendment shall have effect unless and until it has been confirmed by the Minister and until the expiration of one month from such confirmation.
