Clause 42

Contravention of regulations

(1)

The provisions of subsections (2) to (4) and (6) to (9) of section 40 of this Act shall apply mutatis mutandis to any person who, being licensed under section 40 or 41 of this Act to set up any stall, table, showboard, vehicle or receptacle for the purpose of selling or exposing for sale any food or drink or any other goods or to act as an itinerant hawker, as the case may be, contravenes any regulations made under this Act for the control of hawkers.

(2)

The Minister may, in making any regulations for the control of hawkers, provide —

(a)

that any contravention by any person, who is not so licensed, of any specified regulation shall be an offence punishable in the same manner as a contravention of that regulation by a person who is so licensed;

(b)

that the provisions of subsections (2) to (4) and (6) to (9) of section 40 of this Act shall apply mutatis mutandis to any person, who not being so licensed, contravenes any such specified regulation.
