Penalty for preventing execution of this Part
(1)
If any person being the occupier of any dwelling-house prevents the owner thereof or being the owner or occupier of any dwelling-house prevents a Medical Officer of Health or a Public Health Engineer or any person acting on behalf of the owner or of the Commissioner from carrying into effect with respect to the dwelling-house any of the provisions of this Part after notice of the intention so to do has been given to such person, a Magistrate’s Court, on proof thereof, may order such person to permit to be done on such premises all things requisite for carrying into effect with respect to such dwelling-house the provisions of this Part.

Any person who at the expiration of seven days after the service of such order fails to comply therewith shall be guilty of an offence under this Act and shall, for every day during which the failure continues, be liable on summary conviction to a fine not exceeding one thousand dollars:Provided that, if any such failure is by the occupier, the owner shall not be liable to a fine if he has applied for an order under subsection (1) of this section.
