Clause 91

Closure of swimming pools

(1)

The Commissioner may, in his discretion, by notice in writing, require the owner or person in charge of any swimming pool to close such swimming pool within a specified time —

(a)

if he fails to comply with any of the provisions of this Part or of any regulations pertaining to swimming pools made under this Act;

(b)

if there is a generalised epidemic of any infectious disease; or

(c)

if there is an outbreak of an infectious disease in the particular area in which the swimming pool is situated.

(2)

Upon the receipt from the Commissioner of any such notice, such owner or person in charge shall close such swimming pool within such time as is specified in such notice.

(3)

Upon compliance by such owner or person in charge with the provisions that he has contravened as specified in such notice, or upon the cessation of the generalised epidemic of infectious disease or upon the cessation of any outbreak of infectious disease in the particular area in which the swimming pool is situated, as the case may be, the Commissioner shall by notice in writing grant permission to such owner or person in charge for the re-opening of such swimming pool.
