Clause 5

Amendment of section 56

Subsection (1) of section 56 of the Ordinance is hereby amended —

(a)

by inserting immediately before the word “attempts” appearing in paragraph (a) thereof the words “enters unlawfully or”;

(b)

by inserting immediately after paragraph (b) thereof the following new paragraph: —“(c)engages in the business or trade of conveying to Singapore in or on any vessel, aircraft or vehicle any person whom he knows or has reasonable grounds for believing is a prohibited immigrant; or”;

(c)

by deleting paragraph (d) thereof and substituting therefor the following: —“(d)harbours any person who has acted in contravention of the provisions of this Ordinance or of any regulations made thereunder; or”;

(d)

by inserting immediately after paragraph (d) thereof the following new paragraph: —“(e)employs any person who has acted in contravention of the provisions of section 6, 15 or 36 of this Ordinance or of any regulations made thereunder; or”; and

(e)

by inserting immediately after the word “Ordinance” appearing in the last line thereof the following: —“and shall be liable on conviction —

(i)

in the case of an offence under paragraph (c) of this subsection to imprisonment for a term of two years and to a fine not exceeding four thousand dollars;

(ii)

in the case of an offence under paragraph (a), (b), (d) or (e) of this subsection to imprisonment for a term not exceeding one year or to a fine not exceeding four thousand dollars or to both such imprisonment and fine; and

(iii)

in the case of an offence under paragraph (f), (g), (h), (i), (j), (k) or (l) of this subsection to imprisonment for a term not exceeding six months or to a fine not exceeding two thousand dollars or to both such imprisonment and fine”.
