Clause 3

Amendment of Section 7

Section 7 of the Pensions Ordinance, 1956, is hereby amended —

(a)

by inserting immediately after the word “officer” appearing in the second line of paragraph (b) of subsection (2) thereof the expression “, including a police officer of such Auxiliary Police Force as may be specified by the President by notification in the Gazette,”; and

(b)

by inserting immediately after subsection (3) thereof the following new subsections: —“(4) An officer retiring under paragraph (e) or (j) of subsection (2) of this section shall not, where he is granted a pension, be paid such pension until he has attained the age of fifty years:Provided that where such an officer —

(a)

becomes physically or mentally incapacitated to such an extent that he is incapable of continuing in any employment until he has attained the age of fifty years, he may be paid the pension granted to him with effect from the date he is deemed to be so physically or mentally incapacitated; or

(b)

dies before he has attained the age of fifty years, his dependants or legal personal representatives may be paid a gratuity in accordance with the provisions of section 16 of this Ordinance.(5) The pension so granted under subsection (4) of this section shall be computed on the basis of his pensionable service up to the date of retirement as though he had retired on medical grounds under paragraph (c) of subsection (2) of this section except that an officer retired in the public interest under paragraph (e) of subsection (2) of this section may have his pension reduced under the provisions of subsection (2) of section 5 of this Ordinance.”.
