Clause 35

Offences under this Part

(1)

Any person who contravenes any of the provisions of sections 24, 26, 29, 31, 32 and 33 or who contravenes any order made under section 30, shall be guilty of an offence.

(2)

Where a medicinal product is sold, supplied or imported in contravention of an order made under section 30, any person who, otherwise than for the purpose of performing or exercising a duty or power imposed or conferred by or under this Act or any other written law, is in possession of the medicinal product, knowing or having reasonable cause to suspect that it was sold, supplied or imported in contravention of the order, shall be guilty of an offence.

(3)

Any person guilty of an offence under subsection (1) or (2) shall be liable on conviction to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding two years or to both such fine and imprisonment.

(4)

Any person who contravenes any conditions prescribed for the purpose of section 25 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding two thousand dollars.
