Offences by bodies corporate
(1)
Where an offence under this Act committed by a body corporate is proved to have been committed with the consent and connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body corporate, or any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
(2)
In relation to a body corporate carrying on a retail pharmacy business, subsection (1) shall have effect in relation to a person who (not being such an officer of the body corporate as is mentioned therein) —
is the superintendent; or
at any premises where the business is carried on, is the pharmacist who acts under the directions of the superintendent,as if he were such an officer of the body corporate.
