Clause 12

Commissioner may cause trees to be properly planted, etc.

(1)

If —

(a)

trees and plants are not planted in accordance with the approved plans and specifications; or

(b)

open spaces are not made up in accordance with the approved plans and specifications,to the satisfaction of the Commissioner in any case where a deposit has been made under section 11, the Commissioner may, at any time, after the service of a notice on the person who made the deposit cause the trees and plants to be planted, or execute or cause works to be carried out to ensure that the open spaces are made up, in accordance with the approved plans and specifications.

(2)

The cost of any works to be carried out by the Commissioner under subsection (1) shall be recovered from the deposit made under section 11.
