Clause 13
Refund of deposit on completion of works
(1)
Where a deposit has been made under the provisions of section 11 and trees and plants have not been planted, or open spaces are not made out, in accordance with the approved plans and specifications, the Commissioner may, upon an application being made in the prescribed manner, refund to the person who made the deposit the whole or part of the deposit.
(2)
The Commissioner may retain the deposit or part thereof if he is of the opinion that —
trees and plants have not been properly planted; or
the open spaces have not been properly made out in accordance with the approved plans and specifications; or
it is required for a period of maintenance, which period shall not exceed twelve months from the date of completion of the works described in the approved plans and specifications.
