Clause 14

Penalty for polluting water

(1)

The Minister may control the quality of and regulate the storage and use of any water in any watercourse, river, reservoir, lake or pond and may prescribe such regulations as he deems necessary to provide for such control and regulation.

(2)

Any person who causes any oil, chemical, sewage, trade effluent or any noxious or polluting matter to be discharged into any drain, lake, pond or reservoir shall be guilty of an offence and shall be liable on conviction to a fine not exceeding five thousand dollars and in the case of a second and subsequent conviction to a fine not exceeding ten thousand dollars.

(3)

Subject to the provisions of subsection (5) any person who causes or suffers any oil, chemical, sewage, trade effluent or other impurities, whether solid or liquid, to enter or pass into any drain, river, lake, pond, or reservoir, whether wilfully or by accident, shall forthwith inform the Director of such occurrence.

(4)

Any person who fails to comply with the provisions of subsection (3) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding five hundred dollars.

(5)

The requirements of subsection (3) may be waived by the Director in any case where the amount of oil, chemical, sewage, trade effluent or other impurities referred to in subsection (3) is, in the opinion of the Director, not of a substantial nature.
