Clause 29

Appeal from decision of Commissioner

(1)

Subject to subsection (3) of section 24, any person aggreived by any order of the Commissioner made under this Act may appeal therefrom to the High Court whose decision thereon shall be final.

(2)

Subject to rules of court, the procedure in an appeal to the High Court shall be the procedure in a civil appeal from a District Court with such modifications as the circumstances may require:Provided that no appeal shall lie against any order unless a substantial question of law is involved in the appeal and the amount in dispute is not less than one thousand dollars.

(3)

Notwithstanding any appeal under this section, the employer shall deposit with the Commissioner the amount of compensation determined by the Commissioner under section 25 within twenty-one days from the date of the Commissioner’s decision, and such deposit shall be held by the Commissioner pending the outcome of the appeal.

(4)

Where an employer fails to make a deposit with the Commissioner under subsection (3), he shall be liable to pay to the Commissioner interest at the rate of one and a half per centum for each month or part thereof:Provided that the Commissioner may in his discretion waive or remit the whole or any part of such interest.
